That is the problem, people without the ability to take back the pups shouldn't be breeding them at all. But there is no law against it so they do. Laws are created because people don't always do the right thing, meanwhile dogs are being killed every minute of the day and paying the price for regular people who shouldn't be breeding, and irresponsible owners. I think that something needs to be done to reduce the amount of dogs that are being put down-and waiting for the invisible hand to solve this isn't going to happen in this situation so legislation is needed, but not quite what PETA has in mind.
