Frankly, I cannot give it that opportunity. Judges and juries sometimes put human thoughts and feelings on dogs. They think that a 70 pound 11 month old puppy could not possibly be terrified of an 8 pound dominant aggressive dog and bit out of self-preservation. The pup is viewed as a blood thirsty wolf dog bully, and the aggressor is viewed as a poor victim puppy. Not willing to let my dogs get in that kind of a mess.
So, if a little rat dog comes snarling at my dog, than I will hold my dog back and yell at it forcefully, if that does not work I will kick it hard. Then they can take ME to court, and I will tell the court that the dog was not under control, it was coming for me, and would not stop when I yelled at it, so I defended myself. I will leave my dog out of it. Not sure what will happen in the thick of things, but like to think I would take a bite for my dogs.
