Pedestrian/Car Accident/24-70 Lens Test w/Photos/Life Update Thread
 
So this is a mixture of a story and some photos taken with my new, and now destroyed (Within two weeks of being in my possession of it) 24-70 2.8 for my D3s)...Which is also destroyed.

So it was New Years Eve and I decided to go the boring, sober route. As a lot of you know, I got my BA in Photography and I decided I would go down to the little travelled cul-de-sac at the end of my street to take some long exposures of sparklers and write some things in the frame for the New Year. Behind me in the cul-de-sac is one street lamp, to my left a row of houses on either side of the street with left over Christmas lights lit up for the evening. So there's enough ambient light to easily see that there's someone down there. I get out there on 12/31/13 and start testing my exposures at 6:57 p.m. (I know this from the Metadeta in my camera).

Here's a clear image of where I was to give you an idea of the ambient light around the area:

That's a RAW image, straight from my D3s...No editing whatsoever. You can see that the there's enough ambient light to tell that there would have been someone/someTHING in that cul-de-sac. How could one not see me in there with so much ambient light AND your headlights on, as your claim states?

Anyway, I was finishing up with my last photo at 7:18 p.m. when a white SUV comes barreling into the cul-de-sac doing what I would say was around 20-22 miles per hour. They run around the edge of the circle, and as I'm taking my camera of the tripod I'm watching them out of the corner of my eye thinking, 'Oh, they're going to slow down and avoid me'....But when they didn't...And got closer to me, I realized they were headed straight for me. I got that "deer in the headlights" look for two seconds before realizing that I needed to move, and quick, or I would be hit. So I jumped back, but not quickly enough....They hit my right side, knocked me to the ground, ran over both my feet stopping on my left. I think at that point they realized that they had hit someone, and backed up off my left foot again. It was a husband and wife, and when they got out of the car, the wife just stood there staring at me, mouth agape, hands on cheeks, in shock (Kind of like myself). The husband said, and I quote:

"Oh my god...Which house do you live in? Where do you live? Is it this one? This one?"...As he runs back and forth up and down the street.

I look down at my feet, see the blood and carnage and begin screaming, "Call 911, now! HELP! ANYONE HELP! It doesn't matter which house! Pick one! Call 911!" As the guy continues to run up and down the street. My yelling evokes some of the neighbors from their houses, and by then a number of them are calling 911. In the meantime, the man who was driving had run around for so long that I finally yelled to him in sheer anger, "Third house on the left!!!!!"

He runs there and this is what my Mother said took place...He knocked on the door and she answered, he said to her, "Was your daughter taking pictures in the cul- de- sac?", "Yes", "Well, she just got hit by a car". No accountability whatsoever. He never said that HE ran me down, heh.

Anyway, here's a couple images showing what I was doing down in that cul-de-sac. Nothing special, just having fun:

So my body (D3s is destroyed), NEW 24-70 2.8 is destroyed, tripod is destroyed. LUCKILY my other gear was spared. That's still almost $5000 worth of equipment lost. I know I need to focus on what's important right now, which is getting better, but that's my livelihood, my support, job, life...I NEED that to survive in more ways than one. That man took away what's SO important to me. I'm so angry with him.

I got taken away by the ambulance before I knew about the police report being filed. Apparently some untruthful things were said, and because only one side of the store was taken (Theirs), I now have to wait three more days (A total of ten) to contact the police department and let them know I would like to give a sworn statement as well. I was just unable to because I was taken away in the ambulance before they arrived.

Anyway...Almost a week in the hospital, three surgeries later, I'm looking at at least two more skin grafts and another definite week here, plus who knows how long.

Yay.

Don't worry, not to fret....This thread is not all doom and gloom, part two and three are coming in the next couple posts...

Your photos are great, Mel. So sorry that you were hit and I hope your feet and whatever else got hurt on your body are going to be ok. That, and that alone, is the most important thing here. I do understand all about equipment but it isn't more valuable than your body. Your body is irreplaceable.

Also, I have almost hit people and have almost been hit by cars when walking at night. Unless you are wearing highly reflective clothing, you are very difficult to see, no matter how many light sources are around you. For this reason Rafi has a reflective leash and reflective collar for night walks and I have all kinds of reflective stuff.

Part three, and the happiest part of this threat...I'm engaged to the most loving, supportive, amazing man I've ever met and could not be happier. I love him whole-heartedly, and wouldn't trade him for everything I've been through. He's incredible in every way, and the best thing that's ever come into my life....

OMG! I'm so sorry! The whole thing sounds terrible. Good for you for focussing on the good too though! Your pictures are amazing. Here's wishing you a speedy and smooth recovery.

Thanks guys. It was just a freak accident I guess...Horrible timing though. I'll live. Just can't wait to get out of this hospital!

Get a good lawyer...I don't care what light was available...the man hit you with a car, could have easily taken your life, and at the very least compromised your physical soundness for much of, if not all, of the future! The equipment can, and will, be replaced eventually....do you have auto insurance of your own? check and see if the equipment can be covered and if you have disability coverage - it WAS an auto accident even if you were on the ground and not in a car. Also, get a good lawyer...and be careful what you sign, even with the lawyer....they want a big percentage - but negotiate that - out of court settlement vs in court....percentage based on amount awarded....don't just sign off on anything as "standard"....I had lawyers chasing me to represent me - until we found out the guy who hit me had "state minimum" insurance and there was nothing to get by a lawsuit.....

You will get past this...you will get your life back.....in a couple of years, it will be like a bad dream....
