Example: you sell someone a male pup that you consider breed worthy conformation wise, temperament, drive, etc. You find out that this person has bred this dog not once but twice with two litters on the ground before the dog is even a year old. You find out that they have bred the dog, before they have even had the hips OFA'd to say the least of what they should be doing before they bred this dog. They have the OFA'd, and they find out the dog has mild HD, so now they expect you to hold up your end of the guarantee about replacing the dog because of the dog having mild HD. What do you say to them as a breeder?

I *think* most breeders have contracts where any guarantees would be negated by the buyer breaching the contract (again, assuming the original breeder had a contract or some agreement stating the owner would NOT do something like this).

In my contract I have where if they breed before a certain age then my guar. is void. so in that case they can fuse at me all they want but they signed a contract and they breeched it

I'd say nice try. My contract states no breeding before ofa certifications or 'a' stamps.

Most good breeders have clauses that state if one breeds their dog prior to a certain age or attaining final hip certs, the guarantee is fully null and void.
But then the buyer will waste no time in launching a smear campaign against the breeder even though the buyer was the moron, not the poor breeder.

Diana, that exactly what my thought is. The buyer will try to bad mouth the breeder even tho it's the buyer fault. The of course when that happens what does the breeder do?

So how does a breeder handle that? If you as a breeder are completely in the right and the idiot buyer decides to
on your reputation, do you continue enforcing the guarantee or do you try to work something out to smooth the situation? If you enforce your guarantee, how do you practice damage control?

Now WHY would someone tell you that they had violated the contract if they were trying to get you to honor your half of it? This doesn't make sense. Would you check through the registry to try to discover if they had violated the contract when they asked for a replacement? How would you discover they hypotheticals on this?

Maybe they are just not really that bright? Or maybe they didnt fully understand the contract/agreement? Someone you know found out what they did and told you and you confronted the said buyer?
